Common Notices Issued by the Department of Home Affairs

  • Section 109 – Where your visa is approved after providing false information; applies to both permanent and temporary visas
  • Section 116 – Where you have contravened a visa condition (e.g. working without a valid work permit granted with your visa)
  • Section 128 – Applies to visa holders outside Australia; your visa can be cancelled without further notice; same with sections 109 and 116
  • Section 134 – Subclass 132 Business Talent visa may be cancelled if the requirements are not met
  • Section 137Q – Regional employer sponsored visas may be cancelled (e.g. where you fail to satisfy the 2 year sponsorship working conditions)
  • Section 140 – Companion visas may be cancelled; if the primary applicant’s visa is cancelled, all companions’ visas will be subsequently cancelled by operation of law
  • Section 501 – Where you fail to satisfy the Character Test or any Public Interest Criteria
  • Public Interest Criterion 4020 – Where you have provided a bogus document or false or misleading information; approximately 25% of all visa refusals are due to this and you may be subject to a 10 year ban
  • s57 Natural Justice Letter – Final clarification stage where information from a third party source concerning a visa refusal is confirmed
