As an employer, you owe a legal duty to ensure that all minimum standards and conditions of employment as under the Fair Work Act 2009 (Cth), the National Employment Standards, and any applicable Modern Industry Awards are provided to your employees.

The main sources of employment law in Australia are the Fair Work Act 2009 (Cth), the National Employment Standards which are enacted under the Fair Work Act 2009 (Cth), and any Modern Industry Awards that apply to your business and your employees.

It is important to ensure that you follow proper procedures when dismissing an employee. Generally speaking, unless it is an issue concerning serious misconduct by an employee, you should provide formal and written warnings and opportunities to respond prior to dismissing an employee.

If an employee submits a complaint regarding the workplace, do not ignore it. Ensure that you, at the very least, acknowledge the complaint and investigate its basis. It is also recommended that you inform and update the employee of the outcome of the investigation, and the action that will be taken, if any.

Paying your employees an amount that is at least the minimum wage is one of the most important obligations you owe as an employer. The minimum wage that applies to your employees will vary depending on whether a Modern Industry Award applies, and their classification levels.
