As an employee your legal rights and entitlements are protected by the Fair Work Act 2009 (Cth), the National Employment Standards, and the Modern Industry Awards if applicable.

Employers are generally obliged to follow fair and reasonable procedures when dismissing employees. If you have been fired in the absence of a proper reason, you may be entitled to make an unfair dismissal or unlawful termination claim.

Workplace bullying and harassment can be an extremely stressful and unpleasant experience. If you are being subject to bullying or harassment by your employer or colleagues, you may be entitled to make a claim to the Fair Work Commission or a relevant Human Rights Commission.

Privately resolving issues with your employer is generally the most mutually beneficial and cost-efficient process for all parties. However, understandably, this may not always be a viable option. All employees are entitled to be paid the applicable minimum wage, either under the National Employment Standards or an applicable Industry Award. If your employer fails to pay you the minimum wage, you may be entitled to make a claim for unpaid wages. However, any claims in relation to unpaid wages are subject to a 6-year limitation period.

Full-time and part-time employment is considered to be forms of permanent employment, unlike casual employment. Full-time and part-time employees are provided regular and systemic hours of work as well as paid annual and personal leave benefits, whereas casual employees do not have such rights. Casual employees are subject to fluctuating working hours, and do not accrue paid leave benefits, but generally receive a higher base rate of pay.

Having a written employment contract is not a legal requirement, however it is always recommended that a clear agreement with your employer regarding the terms and conditions of your employment are properly discussed and recorded.

The Fair Work Ombudsman and the Fair Work Commission are formal administrative bodies enacted to enforce the Fair Work Act 2009 (Cth) and its related instruments.
