How Much Can I Get for My Compensation?

It is a lawyer’s job to help their clients understand how compensation claim works, what rights they have according to law, gather evidence, show proofs, communicate with the other side on their behalf, negotiate, navigate options, and proceed to litigation with them if necessary. Once all evidence falls into hands, your lawyer will be able to advise a reasonable estimate on the range of compensation that you should be entitled to.
The instinctive question for any injured person that makes a claim for compensation is how much they are entitled to. Many people are curious about this even prior to starting a claim. While we understand the curiosity, as a lawyer, the honest and accurate answer to this is that we don’t know until all the evidence falls into our hands.
 
Unfortunately, lawyers don’t have a crystal ball to predict what will happen in the future. They can only depend on and act on evidence, what clients say to them about their injuries and the aftermath, and on probabilities of future events. It’s not a simple and straightforward exercise. In order to properly make a claim or consider making a claim, the injured person should seek legal advice and commence a claim with a lawyer.

Providing a definite answer on how much compensation would be even prior to starting a claim is not a proper exercise, and relying on that answer may be dangerous. There is no universal equation or macro-like program that determines the amount of compensation. Each case is dealt with differently.

How Is Compensation Decided?

The assessment of compensation is a complex exercise. It requires examination of evidence that shows how much loss and damage the injured person suffered; his or her background and surrounding circumstances; his or her pre-existing medical history; the medical opinion of specialists; application of relevant laws; how court has dealt with similar cases previously; assessment of probabilities as to future events; the injured person’s credibility and many more.

Should I Still Make a Claim?

Short answer is yes, as long as 1) you can prove your injury is as a result of someone else’s fault; 2) that injury is causing you loss and damage; 3) and the law says you can make a claim. If you satisfy these three things, then you are likely to receive compensation. In terms of the amount of compensation, you should seek legal assistance and obtain evidence to prove the extent of your loss.
